Terms of Use

These Terms of Use ("Terms") govern your access to and use of the CityBites app and website (the "Service"), operated by Bing Studios ("CityBites", "we", "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

CityBites is a food-first travel discovery and itinerary app. It generates restaurant and food recommendations and itineraries, helps you discover food cities, and links out to reservation partners so you can book a table. Recommendations are suggestions, not guarantees of availability, quality, or suitability.

Some features require an account, created with email, Apple, or Google. You are responsible for keeping your credentials secure and for activity under your account. You must be at least 13 years old to use the Service. You can delete your account at any time from the Profile screen.

When using CityBites, you agree not to:

• Break the law, infringe others' rights, or misuse the Service.
• Post, share, or transmit content that is objectionable, abusive, harassing, hateful, threatening, sexually explicit, or otherwise inappropriate, including in shared trips, comments, and place suggestions.
• Attempt to access accounts, data, or systems you are not authorized to access.
• Scrape, resell, or redistribute our content or the data of our providers except as the Service allows.
• Interfere with or disrupt the Service, or circumvent its limits or security.

CityBites offers an optional paid subscription, CityBites+, with monthly and annual plans and a free trial. Subscriptions are purchased through your Apple ID, and payment is charged at confirmation of purchase.

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel a subscription anytime in your App Store account settings. Where a free trial is offered, any unused portion is forfeited when you purchase a subscription.

When you tap "Reserve a table" or open a restaurant link, you are taken to a third party such as OpenTable, which operates under its own terms and privacy policy. We are not responsible for third-party services, their availability, or your bookings with them.

CityBites may participate in affiliate or referral programs, and where it does, may earn a commission when you book or buy through links in the Service. This never changes the price you pay and does not influence which restaurants we recommend.

The Service, including its software, design, brand, and original content, is owned by CityBites and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. Restaurant and place data is provided by Google Places and remains subject to its rights.

You retain your saved trips, favorites, and preferences. You grant us the limited rights needed to operate the Service, such as storing and displaying that content back to you. Our handling of your information is described in our Privacy Policy.

CityBites lets you collaborate on trips with people you invite, including comments and place suggestions. There is zero tolerance for objectionable content or abusive behavior. Do not post content that is offensive, harassing, hateful, threatening, sexually explicit, or otherwise objectionable, and do not harass, bully, or abuse other people.

You can report objectionable content and block abusive users from within the app. We review reports and act within 24 hours, removing the content and removing or banning users who violate these Terms. We may remove content or suspend accounts at our discretion to keep CityBites safe for everyone.

The Service is provided "as is" and "as available", without warranties of any kind. Restaurant details, hours, availability, and recommendations come from third parties and may be inaccurate or change. Always confirm key details directly with a venue before you rely on them.

To the fullest extent permitted by law, CityBites is not liable for indirect, incidental, special, or consequential damages, or for any lost profits, data, or goodwill, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

We may update the Service and these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app. Continued use after changes take effect means you accept the updated Terms.
